Native American Artifacts Policy

Under the Indian Arts and Crafts Act of 1990, it is illegal to suggest an item is from Native American or Tribal origin unless the item was made by a member of a state or federally recognized Native American Tribe, a Native American Tribal Organization, or a certified Native American craftsman. If the item does not meet these requirements, you may describe the item as Native American style or Southwest style.

In addition, Mercari prohibits the sale of the following Native American items:

  • Grave markers
  • Items placed at gravesites of the dead
  • Sacred items such as prayer masks and prayer sticks
  • Other objects of significant cultural patrimony
